These Terms of Use (“Terms”) govern your access to and use of the websites, emails, and other online services provided by Caring Minds (“Caring Minds,” “we,” “us,” or “our”) that deliver our educational program (collectively, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy.

Not medical or crisis care. Caring Minds provides educational information only. We do not provide diagnosis, treatment, therapy, or crisis intervention through the Services. If you are in danger or considering self-harm, call your local emergency number immediately. In the U.S., call/text 988 (Suicide & Crisis Lifeline) or dial 911.

1) Eligibility

You must be 16 years of age or older and able to enter a binding agreement to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2) Accounts & Security

You are responsible for the activity on your account and for keeping your credentials secure. Tell us promptly at caringminds.usa@gmail.com if you suspect unauthorized use.

3) Acceptable Use

You agree not to:

• Violate any law or others’ rights (including privacy and IP rights).

• Harass, bully, or threaten; post hateful, exploitative, or violent content.

• Promote self-harm or dangerous activities.

• Impersonate others or misrepresent your affiliation.

• Upload malware or attempt to bypass security or rate limits.

• Scrape the Services without our written permission.

• Present yourself as a health professional or provide medical/therapeutic advice unless you are specifically authorized by Caring Minds and clearly identified as such.

We may moderate, remove content, and suspend accounts that violate these Terms or our Community Guidelines.

4) User Content & License

You retain ownership of content you submit (“User Content”). You grant Caring Minds a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and adapt your User Content only as needed to operate, secure, improve, and promote the Services. You represent that you have the rights needed to grant this license and that your User Content complies with law and these Terms. You can delete your posts where the product allows; backup copies may persist for a limited time.

5) Intellectual Property

Except for User Content, the Services and all materials we provide are owned by Caring Minds or our licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our permission. You may link to public pages in a fair, non-misleading manner.

6) Educational Content; No Professional Advice

Content is provided for general educational purposes. It should not replace advice from a qualified health professional. Reliance on any information provided via the Services is at your own risk.

7) Third-Party Services & Links

The Services may link to or integrate third-party sites or tools (e.g., video, email, analytics). Those services are governed by their own terms and privacy policies. We are not responsible for third-party services.

8) Feedback

If you submit feedback or suggestions, you grant us a perpetual, worldwide, royalty-free right to use them without restriction or compensation.

9) Donations (if offered)

If we accept donations through the Services, payments are processed by third-party processors under their terms. We do not store full card numbers. Any statements about tax-deductibility depend on your jurisdiction and our status; please keep your receipt.

10) Disclaimers

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise the Services will be uninterrupted, secure, or error-free, or that content will be accurate or complete.

11) Limitation of Liability

To the maximum extent permitted by law, Caring Minds and our directors, employees, and volunteers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claims relating to the Services will not exceed the greater of USD $100 or the amounts you paid to us for the Services in the 12 months before the claim.

12) Indemnification

You agree to defend, indemnify, and hold harmless Caring Minds from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your User Content, or your violation of these Terms or others’ rights.

13) Suspension & Termination

You may stop using the Services at any time. We may suspend or terminate access (with or without notice) for violations of these Terms, to protect users or the Services, or if we discontinue features.

14) Changes to the Services and to These Terms

We may update the Services and these Terms from time to time. We’ll post the new effective date, and where required we’ll provide notice. Your continued use after changes take effect means you accept the updated Terms.

15) Governing Law & Venue

These Terms are governed by the laws of the State of California, U.S.A., without regard to conflicts-of-law rules. You and Caring Minds agree to the exclusive jurisdiction and venue of courts located in California, U.S.A. to resolve any dispute arising from or relating to the Services or these Terms.

16) Transfers in a Reorganization

If Caring Minds undergoes a merger, reorganization, program transfer, or similar event, we may transfer information to the successor organization for use consistent with our then-current Privacy Policy and these Terms. If the successor plans materially different uses, we will provide notice and any choices required by law.

17) Severability; Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver.

18) Entire Agreement

These Terms, together with the Privacy Policy and any feature-specific terms, are the entire agreement between you and Caring Minds regarding the Services.
